Dear Mr. President,

We, members of Congolese civil society organisations from all provinces of the country, working in different areas of democratic and community development and human rights, with the support of international partner organizations, write you this public letter to express our strong concerns about the attacks against the National Assembly and the rule of law committed under instructions from members of the Alliance for the Presidential Majority (AMP).

We implore you to personally intervene and to use your constitutional powers and political authority as leader of the AMP to: (1) ensure that the rule of law is fully respected by law enforcement officials and members of the AMP, and (2) to bring to an end all intimidation and threats, which undermine the independence of parliament and violate the rights to freedom of expression, association and assembly.

Along with our fellow citizens and international observers, we are monitoring with great apprehension the current political crisis engendered by the efforts of the AMP to force the resignation or dismissal of the president of the National Assembly.

This conflict has already given rise to human rights abuses by the government, such as the arbitrary arrest, on Sunday, March 15, of human rights defenders who were planning a demonstration to denounce the destabilizing actions against the parliament. These defenders were detained for more than 48 hours in the prison cell of the Special Services of the Police at Kin-Mazière. On Monday, March 16, several students were taken in for questioning as they were attempting to peacefully demonstrate their support for the president of the National Assembly on the day of the opening of the March parliamentary session.

Contrary to the usual practice, representatives of the judiciary joined members of the government and deputies of the AMP in their decision to not attend the official opening ceremony of the parliamentary session.  This absence calls into question the independence of the judiciary. The national broadcaster, RTNC, was also prevented from broadcasting the opening speeches. These incidents seem to indicate that if the AMP's efforts to force Mr. Vital Kamerhe to resign are not immediately stopped, they could create a climate conducive to the use of repression by the security forces and police.

We are convinced that these arbitrary arrests, threats and acts of intimidation will have negative consequences on the independence of parliament and on its capacity to efficiently exercise control on the executive branch, as is provided for in article 100 of the constitution.

Since the successful and historic elections in 2006, we have followed with great interest the activities of the two chambers of parliament in the fields of our respective organisations. We are well aware of the many limitations of parliamentary activity; indeed, allegations of parliamentary corruption have occasionally featured in the press, and the National Assembly itself has recently launched an enquiry into this. But we have also noted the many accomplishments of parliament, despite its limitations and weaknesses.

In the two years of its operation, the legislative output of the current parliament has been quite remarkable. Parliament has voted for an impressive number of laws that are essential in creating an environment conducive to respect for human rights, as well as an independent judiciary and the promotion of good governance. It is important to note that the vast majority of these laws were drafted by parliamentarians as members bills, demonstrating the commendable effort made collectively by the deputies and senators.

Parliament's work in supervising the executive branch, as enshrined in article 100 of the Constitution, has also been impressive. Oral or written questions posed to members of the government lead to debates that contribute to educating and informing the public on issues of national interest, such as corruption within the extractive industry, management of state-owned enterprises, governance in the education system, and integrity in the awarding of public contracts, amongst others. The establishment of parliamentary commissions of inquiry has also provided a forum for citizens, and notably victims of human rights violations, to express themselves and to directly address their elected representatives.

None of these accomplishments, however minimal they may be, would have been possible without a measure of institutional independence for parliament and without the individual freedom granted to each of its members, regardless of their political ties. Yet this very independence and freedom were directly threatened by the political action of members of the AMP against the president of the National Assembly and the parliamentary institution.

We believe that each political party, or coalition of political parties, has the right to ensure that discipline prevails and to maintain political cohesion within its ranks. However, we also believe that such actions must be taken with strict respect for the law and internal rules of the National Assembly, and not by the use of threats, intimidation, corruption and other illegal practices. Several deputies have reported receiving individual threats in recent weeks, including death threats, if they do not follow the instructions given by political leaders of the AMP. Such tactics are in clear violation of the law and threaten democracy.

The right of political parties to maintain discipline and cohesion must also be exercised in a way that, above all, accommodates the interest and will of the voters. Undermining the work of elected representatives who have an obligation to communicate directly to voters their views and opinions, even those that run contrary to the party line, denies the people their right to information. We urge you to ensure that the AMP's efforts to foster internal political cohesion are not at the price of the general interest and the right of the Congolese people to a vibrant democracy.

We hope that you will take necessary measures to intervene in time to stop any resort to unlawful means that destabilises the National Assembly. Only respect for the Constitution and for Congolese law will guarantee respect for the independence of parliament and the rights of all Congolese citizens, and will thus preserve the democratic progress marked by the national elections in 2006.
