We would like to call your attention to current discussions regarding the amendments to the General Act to Ensure Women a Life Free of Violence, and specifically amendments to ensure that shelters and Justice Centers for Women are accessible to women with disabilities. We urge the lower house of the Mexican government to pass the amendments as they were adopted by the Senate in November 2021, and provide specific resources to facilitate the reform’s implementation.

As you know, one of the Senate’s amendments establishes new provisions that require government agencies at all levels to apply a differentiated approach to women who are survivors of violence. These new provisions require that officials implementing the law account for conditions that might exclude women who are subjected to violence, including those with a disability. The effectiveness of the reform depends entirely on the resources allocated to ensure officials are adequately trained to implement it meaningfully.

These amendments also establish new obligations to ensure women with disabilities can safely access services provided by shelters and Justice Centers for Women. It is crucial that such shelters and Justice Centers for Women are designed to be physically accessible for all users. According to a 2015 study by the National Institute for Women, 80 percent of shelters were physically inaccessible to women with disabilities.[1] Accessibility, however, is much broader than architecture. According to the Convention on the Rights of Persons with Disabilities (CRPD), which Mexico ratified in December 2007, accessibility also includes transportation, information and communications, technologies and systems.[2] Emergency services also need to be accessible to people with disabilities. The amendments under discussion include specific provisions to achieving full accessibility and services for women with disabilities who are survivors of violence. In order for the reform to be effective, it needs sustainable resources and adequate planning.

Crucially, this new amendment should not be barred by budgetary restrictions.

In its 2014 concluding observations for Mexico, the Committee on the Rights of Persons with Disabilities, the body charged with monitoring implementation of the CRPD, expressed concern regarding the facts that women are often the victims of violence and abuse, and that they do not have access to effective protection or reparation measures.[3] Without adequate resources and financial support, the Mexican government will not address the Committee’s concern. We urge the lower house not to introduce budget restriction to this reform, and to provide agencies in charge of implementation with sufficient human and technical resources to achieve full implementation of the amendments.

As the CRPD Committee points out, women with disabilities are at a heightened risk of being victims of violence.[4] Reports on violence against women have detailed the various obstacles women with disabilities face in accessing justice, including protection measures and shelters.

We urge the lower house of the Mexican government to adopt the amendments along with the necessary budget that would allow for their meaningful implementation.
