(ニューヨーク、2017年7月6日)― バングラデシュ政府の法執行当局は、野党活動家などを不法に連行し秘密拘禁しており、その数は2013年以降で数百人に上る、とヒューマン・ライツ・ウォッチは本日発表の報告書内で述べた。バングラデシュ政府は、こうした広範囲にわたる強制失踪を即時にやめ、これらの疑惑を公平かつ独立したかたちで即座に捜査するよう命じるべきであり、失踪者の家族に情報を提供し、こうした重大な人権侵害に責任を負う治安要員を訴追しなければならない。

報告書「『我々は彼を拘束してはいない』:バングラデシュの秘密拘禁と強制失踪」(全82ページ)は、2016年だけで少なくとも90人が強制失踪させられたことを明らかにしている。そのうちの大部分は、数週間または数カ月の秘密拘禁の後、法廷で姿を現したものの、その後殺害された21人のケースや、依然として行方不明の9人のケースを本報告書で調査・検証している。90人には、2016年8月の数週間のうちに次々と拘束された著名な野党政治家の息子3人も含まれている。1人は6カ月間の秘密拘禁の後に釈放されたが、残りの2人は行方不明のままだ。2017年前半の5カ月間にも48件の失踪が報告されている。秘密の拘禁中の厳しい拷問や虐待行為も報告されている。

ヒューマン・ライツ・ウォッチのアジア局局長ブラッド・アダムスは、「一連の失踪は十分に文書化・報告されているが、政府は法の支配を無視してこの忌まわしいやり方を続けている」と指摘する。 「バングラデシュの治安部隊は、人びとを拘禁して有罪・無罪を決め、罰や生死まで自由に決められるようだ。」

本報告書はまた、バングラデシュ民族主義党(BNP)の活動家19人が失踪状態におかれ続けているケースについても調査・検証している。19人の男性は、2014年1月の総選挙前の時期の2週間の間に、首都ダッカ周辺でおきた8件の事件で連行された。

ヒューマン・ライツ・ウォッチは、家族や目撃者を含む100人超に対し、これらの事件を調査・検証するために聞き取り調査を行った。警察への被害届などの法律文書の詳細も本報告書に含まれている。これら一連のケースについて考えを求めたヒューマン・ライツ・ウォッチの書簡に、バングラデシュ当局は回答しなかった。

目撃者と家族はヒューマン・ライツ・ウォッチに対し、これらの人権侵害の大半は緊急行動部隊(RAB)や警察の捜査部(DB)によるものと証言。このふたつの組織については、いずれも長きにわたって人権侵害が指摘されている。19人の野党党員のケースでは、8人はRABに、6人はDBに、残りは未確認の治安要員に連行されたと目撃者たちは話した。

Ruhul Amin Chowdhury 氏は2013年12月5日、RABによって息子のAdnan Chowdhury氏を連れ去られた。しかし翌日には釈放されると信じていたと話す。「彼らは『息子さんを連れて行くが、また返す』と言ったのです。でも裏切られました。」



2013年12月4日に、BNP の著名な地元リーダーSajedul Islam Sumon氏が失踪。あるRAB幹部が、Sumon氏など5人の男性の身柄を拘束していたが、殺害命令を拒否したところ、ほかのRAB 関係者が彼らをどこかに移送したと、家族に対し個人的に認めている。その幹部は、6人全員が殺害されたと考えている。

法執行当局は一連の逮捕を繰り返し否定しており、政府関係者も、失踪した男たちは自発的に身を隠していると示唆したりして同調している。警察は、法執行当局が家族を連行したという被害届の提出さえ認めていない。

強制失踪に加え警戒すべきは、国家当局の秘密拘禁下での死亡ケースの傾向だ。一例として挙げられるのが2016年6月13日に起きた事件。野党イスラム協会の学生活動家Shahid Al Mahmud氏が、「自宅の外に引っ張り出されたうえ、黒いマイクロバスに連れ込まれた」と父親は証言する。この連行には警察が立ち会ったにもかかわらず、後日身柄の拘束を否定したという。警察は2週間後の7月1日に、犯罪者たちとの銃撃戦の後、Shahid Al Mahmud氏の遺体を発見したと述べている。父親はヒューマン・ライツ・ウォッチに、警察は嘘をついていると語った。「息子を拉致し、殺害を正当化するために『銃撃戦』を演出してみせたのです。」

与党アワミ連盟は2009年に政権を握って以来、人権侵害に対する「ゼロ・トレランス」を公約してきたが、超法規的殺人強制失踪は続いており、2009年以降、少なくとも320件の失踪事件を複数の人権団体が報告している。犠牲者・被害者には、犯罪や武力闘争の疑いをかけられた人びと、ならびに野党メンバーも含まれる。

国際法の下で強制失踪は、国の機関などが人の自由を剥奪することであって、その自由の剥奪を認めない、または失踪者の所在等を隠蔽し、失踪者を法の保護の外に置くことと定義されている。

バングラデシュ政府は、これら犯罪の報告を調査し、法の裁き・責任追及・治安部隊の改革を確実にするための適切な提言を得るために、国連人権高等弁務官事務所を招聘すべきだ。加えて、強制的・非自発的失踪に関する作業部会、および拷問に関する特別報告者などの国連専門家も公式に招き、希望する場所や人びとへの全面的かつスムーズなアクセスを認めるべきだ。

前出のアダムス局長は、「バングラデシュ政府にとって、人権、人命、法の支配の完全無視が習わしとなっている」と指摘する。「政府はこれらの人権侵害を否定しようとさえしていない。ひたすら沈黙を守り、かつ国際社会の沈黙に助けられているのである。こうした沈黙はもう終わりにしなければならない。」

“The men approached my son on two motorbikes as he came out of the mosque after attending juma prayer. They handcuffed him after he gave his name and dragged him onto a motorbike at gunpoint. Continuing Disappearances

They just said, ‘Come with us.’ My brother said, ‘I am a lawyer and I need to know these things.’ And then they said, ‘We will give you five minutes to get ready. Get ready and come with us.’ … I stood in front of my brother and held the hand of one of the men. The man pulled away my hand and grabbed my brother. We were running behind him. It was total confusion. There was a white microbus and he was put in it. And the vehicle drove away.”
