H.E. PRESIDENT OF REPUBLIC REQUESTS THE COURT OF APPEAL TO REVIEW

MEDIA LAW

 

Dili, 14 July 2004 - His Excellency the President of the Democratic Republic of Timor-Leste,

Taur Matan Ruak, this Monday, 14 July 2014, submitted Decree no. 10/III of the National

Parliament on Media Law, to the Court of Appeal, requesting a review of constitutionality,

pursuant to articles 149 and 164 of the Constitution.

 

Having discussed this issue with several dignitaries and associations, and received many

petitions, His Excellency the President of the Republic deemed it necessary to submit to the

Court of Appeal the issues raised regarding the constitutionality of the ruling of the National

Parliament.

 

This decision is aimed at ensuring that the regulations approved regarding Freedom of the

Press will not excessively limit the fundamental rights of citizens enshrined in art. 41 of the

Constitution.

Dili, 14 Julho 2014 – Sua Excelência, o Presidente da República Democrática de Timor-

Leste, Taur Matan Ruak, remeteu hoje, segunda-feira, dia 14 de Julho de 2014, o Decreto n.º

10/III do Parlamento Nacional, que aprova a Lei da Comunicação Social, para o Tribunal de

Recurso a fim de este proceder à fiscalização preventiva da sua constitucionalidade, nos

termos do art. 149.º e 164.º da Constituição.

 

Depois de ter recebido várias personalidades, associações e petições, Sua Excelência, o

Presidente da República entendeu submeter ao Tribunal de Recurso as dúvidas suscitadas

acerca da constitucionalidade das normas aprovadas pelo Parlamento Nacional.

 

A intenção é garantir que as normas aprovadas na regulamentação da Liberdade de Imprensa

não restringem de forma excessiva os direitos fundamentais dos cidadãos garantidos pelo art.

41.º da Constituição.
