المجتمع المدني الأفريقي يدعو الدول الأفريقية الأطراف في نظام روما إلى التأكيد على التزامها بالمحكمة الجنائية الدولية

في 3 يوليو/تموز 2009 اتفق الاتحاد الأفريقي على أن دوله الأعضاء ستجمد التعاون مع المحكمة الجنائية الدولية في سياق توقيف وتسليم الرئيس السوداني عمر البشير. وكانت المحكمة قد أصدرت أمر توقيف بحق الرئيس عمر البشير في 4 مارس/آذار 2009 عن جرائم حرب وجرائم ضد الإنسانية يُفترض وقوعها في دارفور.

إن قرار الاتحاد الأفريقي يهدد بحجب العدالة عن ضحايا أسوأ الجرائم المرتكبة في القارة. وهذا القرار لا يستقيم مع المادة 4 من نظام إنشاء الاتحاد، الواردة فيه رفض الإفلات من العقاب، وكذلك لا يستقيم مع الالتزامات التعاقدية لثلاثين حكومة أفريقية بتصديق تلك الحكومات على نظام روما المنشئ للمحكمة الجنائية الدولية. كما يقوض القرار من الإجماع الذي توصلت إليه الدول الأفريقية الأطراف في المحكمة الجنائية الدولية في أديس أبابا في يونيو/حزيران 2009.

إننا من واقع التزامنا بالمساعدة على حماية حقوق الإنسان وصيانة سيادة القانون، فإننا - المنظمات الموقعة أدناه - ندعو الدول الأفريقية الأطراف في المحكمة الجنائية الدولية إلى التأكيد على دعمها للمحكمة والتزامها بمراعاة التزاماتها المنشئة بموجب نظام روما، لا سيما فيما يخص توقيف ونقل الرئيس السوداني إلى عهدة المحكمة الجنائية الدولية.

وقد تم تشكيل المحكمة الجنائية الدولية من أجل المساءلة في الجرائم الأكثر جسامة ذات البُعد الدولي: من إبادة جماعية إلى جرائم حرب وجرائم ضد الإنسانية. والحكومات الأفريقية - مع المجتمع المدني الأفريقي - لعبت دوراً ناشطاً في تأسيس المحكمة، وكانت الحكومات الأفريقية من بين أول الدول التي صدقت على نظام روما.

وأغلب الدول الأفريقية أصبحت أطرافاً في المحكمة الجنائية الدولية: بنين وبتسوانا وبوركينا فاسو وبوروندي وجمهورية أفريقيا الوسطى وتشاد وجزر القمر وجمهورية الكونغو وجمهورية الكونغو الديمقراطية وجيبوتي والغابون وغامبيا وغانا وغينيا وكينيا وليسوتو وليبيريا وملاوي ومالي وموروشيوس ومدغشقر وناميبيا والنيجر ونيجيريا والسنغال وسيراليون وجنوب أفريقيا وتنزانيا وأوغندا وزامبيا. وبالتصديق على نظام روما، فقد أعلنت هذه الدول التزامها بالتعاون مع المحكمة في الدفاع عن حقوق الضحايا وضمان مثول الجناة المسؤولين عن أخطر الجرائم المعروفة للإنسانية - أيا كانوا - أمام العدالة.

وسبق في أديس أبابا في يونيو/حزيران الماضي، أن أكدت هذه الدول على استمرار دعمها للمحكمة. ولم تنل الإجماع أية عروض بالنظر في الخروج بتوصيات على صلة بالانسحاب المحتمل من المحكمة الجنائية الدولية، أو بتجميد التعاون مع المحكمة.

إن القرار الذي تم تبنيه في القمة الأفريقية قبل ثلاثة أسابيع هو خطوة للخلف. فالأسانيد التي استند عليها الاتحاد الافريقي في تجميده التعاون مع المحكمة هو عدم رد مجلس الأمن على طلب من الاتحاد الأفريقي بتجميد قضية المحكمة الجنائية الدولية بحق البشير. وتبعاً لالتزامات الدول الأطراف بنظام روما، فهذه مسألة يمكن توجيهها إلى مجلس الأمن، لكنها لا تكفي لوقف التعاون مع المحكمة.

وإثر قمة الاتحاد الافريقي، أصدرت حكومتا بتسوانا وأوغندا تصريحات تؤكد فيها على التزامها بالتعاون مع المحكمة الجنائية الدولية، وهذه التصريحات هامة.

وقد أبدت منظمات المجتمع المدني في شتى أنحاء القارة القلق إزاء قرار الاتحاد الأفريقي. وضمان عدم تقويض الخطوات اللازمة لوضع حد للإفلات من العقاب في قارتنا يتطلب جهداً جماعياً من جميع الأفارقة. وبدلاً من التراجع على مسار الإنجازات المتحققة حتى الآن، فإننا نتطلع لأن تثبت حكوماتنا على دعمها للعدالة لصالح ضحايا أسوأ الجرائم، وما يتبع هذا من وجوب التأكيد على التزامها بالتعاون مع المحكمة الجنائية الدولية.
