這份76頁的報告,《「我覺得自己有缺陷」:南韓校園忽略LGBT年輕人的權利》,發現LGBT學生面臨特別迫切的難題包括霸凌與歧視,缺乏具保密性的精神健康支持,被學校課程排斥以及性別認同的歧視。南韓政府應當實施反歧視保障,確保LGBT年輕人獲得維護其健康與教育的支持資源。
「南韓LGBT學生經常在課堂上面臨來自成年人以及其他同學的霸凌與歧視,」人權觀察LGBT權利研究員萊恩・托瑞森(Ryan Thoreson)說。「在沒有明確保障之下,許多學生只能選擇隱忍,犧牲他們的教育和身心健全。」
人權觀察與洛溫斯坦診所訪問了26位目前在學和曾經在學的學生,以及41位教師、家長、服務提供者和倡導者,受訪者主要來自首爾市、忠清北道清州市和忠清南道天安市。許多學生表示,他們在發覺自己是女同性戀、男同性戀、雙性戀或跨性別者之後感到十分孤單,當他們遭遇疑難或在學校受到欺負時也無處詢問和尋求支持。

接受本報告訪問的年輕人談到被排斥和擯棄,被網路霸凌,或者受到身體或性的騷擾等經驗。一位22歲的女同性戀者回憶,她的性取向在上初中時被人知道後,隨即遭到指名騷擾,「高年級學生罵我說:『你是同性戀,你好骯髒。』」
一位17歲少女回憶,曾聽到班上同學說同性戀該死。
跨性別學生也因學校裡的性別限制而飽受困擾。許多南韓學校將學生按性別分開,或者按性別區分制服或設施,而且不准學生依照自己的性別認同就讀學校。這可能對跨性別學生構成特殊困難,令他們持續感到不適或苦惱而妨害其接受教育的能力。
年輕LGBT人士在校園面臨的侵害,還會因為缺乏支持資源而雪上加霜。校內心理輔導員並未接受必要訓練,以確保他們有能力與LGBT年輕人一同工作。許多學生表示無法充分信任老師或心理輔導員,因為擔心他們會違反保密原則,或批評他們的性取向或性別認同。
既有保護學生權利與福祉的方案,通常忽視LGBT學生的需要。雖然南韓已成立專為年輕族群服務的心理諮商中心和精神健康熱線電話,但據曾經求助的年輕人表示,這些服務並未肯定多元性取向和性別認同,有時甚至公然加以批評。據學生指出,國民性教育課程並未包含任何有關LGBT議題的內容,其他課程也很少討論LGBT議題,即使談到也通常是負面表述。

人權觀察與洛溫斯坦診所表示,立法者和校方主管應立即採取措施,確保學校能為LGBT學生提供安全和包容的環境。國會應制定完整的反歧視法及相關保障措施,以杜絕校園霸凌。教育部和性別平等與家庭部也應採取措施,在國民性教育課程和普及南韓年輕人的心理健康資源當中納入LGBT相關資料。
學校主管應落實各項促進包容與支持的政策,具體措施包括將LGBT議題融入教職員培訓與學校課程,以及在學生遭遇不當對待或困擾時的秘密通報和援助制度。
「學校必須成為安全且包容的空間,使所有年輕人都能安心求學,」托瑞森說。「立法者和學校主管必須採取有效措施,使南韓的LGBT學生都能求知成長而不必擔憂霸凌、排斥和曝光。」
