מכתב פתוח לתובע של בית הדין הפלילי הבינלאומי
ארגוני חברה אזרחית קוראים לתובע לחקור פשעים בפלסטין ולהרתיע מפני הישנותם
אדוני התובע,
אנו, החתומים מטה, היננו ארגוני חברה אזרחית פלסטיניים, אזוריים ובינלאומיים, לרבות אלה שהוצאו אל מחוץ לחוק על ידי ישראל בשל עבודתנו למען מתן דין וחשבון ולניטור ותיעוד הפרות של המשפט הבינלאומי נגד קורבנות פלסטינים, לרבות פשעי מלחמה ופשעים נגד האנושות.
כתובע של בית הדין הפלילי הבינלאומי הקבוע (ICC), ערכאת המוצא האחרון עבור קורבנות הפשעים החמורים ביותר, המנדט שלך מאפשר לא רק לחקור פשעים בינלאומיים, אלא גם לנטר התרחשויות בתחום שמשרדך חוקר ולמלא את תפקיד המתריע בשער; ובפרט, נייר המדיניות של משרד התובע (OTP) מסמיך את משרדך לפרסם הצהרות מנע מרתיעות "שיאפשרו למשרד להגיב מיידית על התפרצויות אלימות באמצעות קידום פנייה מקדמית למדינות, לארגונים בינלאומיים וארגונים לא ממשלתיים כדי לאמת מידע על פשעים לכאורה, לעודד הליכים משפטיים מקומיים אמינים ולמנוע הישנות פשעים".
משרד התובע פרסם מספר הצהרות מנע על המצב בפלסטין, לרבות בנוגע להסלמה באלימות בחודש מאי 2021 ברצועת עזה ובגדה המערבית, ובכלל זה במזרח ירושלים, וכן בנוגע להחמרת המצב ברצועת עזה במהלך ההפגנות ההמוניות של צעדת השיבה הגדולה באפריל 2018. יעילותן של הצהרות מסוג זה ביצירת הרתעה מספקת כבר הוכחה בכמה הזדמנויות. למשל, כאשר התובעת לשעבר בנסודה פרסמה הצהרת מנע בנוגע לתוכנית לפנות בכפייה את הקהילה הבדואית ח'אן אל-אחמר בגדה המערבית, אישר שר החוץ של ישראל כי ישראל לא פינתה את ח'אן אל-אחמר מחשש לפתיחת חקירה בבית הדין הפלילי הבינלאומי. דוגמה זו ממחישה חד-משמעית כי הצהרות מנע כאלה יכולות ליצור הרתעה מספקת.
בשנה האחרונה הוחמצו הזדמנויות לפרסום הצהרות מנע. כך לדוגמה, לא פורסמה הצהרת מנע במהלך המתקפה הצבאית הישראלית האחרונה על רצועת עזה שנמשכה שלושה ימים, בין 5–7 באוגוסט 2022, ואשר נפתחה ללא פרובוקציה ברורה והובילה להרג של 49 בני אדם, לרבות 35 אזרחים, בהם 17 ילדים וארבע נשים. בדומה לכך, לא פורסמו הצהרות מנע מסוג זה גם כאשר הצבא הישראלי פשט על מסגד אל-אקצא ומתחם אל-חראם א-שריף במזרח ירושלים הכבושה ותקף מתפללים. זהו האתר השלישי בקדושתו עבור מוסלמים, והפשיטות בוצעו במהלך חודש הרמדאן, החודש הקדוש ביותר בלוח השנה המוסלמי. התקפות אלה הסלימו את המצב עד כדי איום ממשי על השלום והביטחון באזור. יש לציין כי הצהרה של משרד התובע – בנוסח שמשרדך עוקב אחר המצב וכל פשע חמור שיבוצע עלול להיכלל בחקירה זו – תוכל לייצר את ההרתעה הנדרשת ולסייע בהפחתת סבלם של קורבנות פלסטינים.
ב-22 באוקטובר 2021 הגדיר שר הביטחון של ישראל שישה ארגוני חברה אזרחית פלסטיניים בולטים כ"ארגוני טרור". הגדרה זו גררה גינויים בינלאומיים, בין היתר מצד האיחוד האירופי, כמה ממדינות האיחוד ומומחים של האו"ם, לרבות בין היתר, דווח האו"ם המיוחד למאבק בטרור והנציב העליון של האו"ם לזכויות האדם. שלושה מהארגונים הללו, אל-חק, א-דמיר והאגודה הבינלאומית לזכויות הילד-פלסטין (DCI-Palestin), סיפקו למשרד התובע מידע בנוגע לפשעים חמורים שבוצעו לכאורה בידי אזרחי מדינת ישראל, לרבות אנשי כוחות הביטחון, בגבולות סמכות השיפוט של בית הדין.
הגדרה זו של ארגוני החברה האזרחית הפלסטיניים הבולטים היא הצעד האחרון במסע דיכוי משומן היטב נגד הארגונים, ככל הנראה בעיקר עקב עבודתם היעילה מול משרדך. בדו"ח שפרסם על פעילויות הבדיקה המקדמית לשנת 2016, משרדך הכיר בכך ש"אנשי צוות של ארגונים [פלסטיניים] מסוימים, שאספו מידע רלוונטי עבור הבדיקה המקדמית של משרד התובע כגון אל-חק ואל-מיזאן, היו בבירור מטרה לאיומים ולמעשי הפחדה והפרעה אחרים", מבלי לייחס את האיומים למקור ספציפי. נציין כי אמנת האפרטהייד, המקור הראוי לפירוש הגדרה זו, מזכירה ספציפית "רדיפת ארגונים ואנשים באמצעות שלילת זכויות וחירויות היסוד שלהם, בשל התנגדותם לאפרטהייד" כ"מעשה לא אנושי" של אפרטהייד.
ב-18 באוגוסט 2022 פשטו כוחות ישראליים על משרדי ששת הארגונים: אל-חק, א-דמיר, האגודה הבינלאומית לזכויות הילד-פלסטין (DCI-Palestin), מרכז ביסאן למחקר ולפיתוח, איגוד ועדות הנשים הפלסטיניות ואיגוד ועדות העבודה החקלאית, וכן איגוד ועדות העבודה בתחום הבריאות. הצבא הישראלי החרים מחשבים וציוד, אטם דלתות כניסה וסגר רשמית את הארגונים מכוח צו צבאי. מעשים כאלה של "השחתת ראיות או הפרעה לאיסופן" בידי הצבא הישראלי, היו עלולים, אילו בוצעו למשל בשלב המשפט, לעלות כדי "עבירות נגד עשיית הצדק" כפי שנקבע בסעיף 70 לאמנת רומא.
כפי שידוע לך היטב, ישראל מונעת באופן שיטתי מארגונים בינלאומיים רבים גישה לשטח הפלסטיני הכבוש, לרבות הדווחים המיוחדים של האו"ם וועדות חקירה. עקב כך, ארגוני חברה אזרחית פלסטיניים מאפשרים לקהילה הבינלאומית ולגופי החקירה הרלוונטיים, ובכלל זה בית הדין הפלילי הבינלאומי, את אחת הדרכים היחידות לגשת לקורבנות ולקהילות בפלסטין. אף שפגיעתה של ישראל בארגונים אלה עלולה להפריע לעבודת בית הדין הפלילי הבינלאומי, משרדך לא הגיב על כך פומבית. אנו מזכירים לך שכאשר ממשל טראמפ איים להטיל סנקציות על בית הדין ועל אנשיו מכוח צו נשיאותי 13928 של ארה"ב, החברה האזרחית ומגיני זכויות אדם מרחבי העולם, לרבות הארגונים החתומים מטה, עמדו לצד בית הדין וקראו להפסקת האיומים ולביטול הסנקציות.
ארגוני חברה אזרחית פלסטיניים הגישו למשרדך מידע חיוני ומילאו תפקיד מרכזי בקידום הצטרפותה של מדינת פלסטין לאמנת רומא. ארגונים פלסטיניים ימשיכו לתמוך במאמציו של בית הדין הפלילי הבינלאומי לשים קץ להיעדר הדין וחשבון. אף שאנו מודעים למשאביו המוגבלים של בית הדין ולקשייו התקציביים, כמו גם לעומס העבודה ולאתגרים שמשרדך מתמודד עימם, אנו נאלצים להדגיש כי הקורבנות הפלסטינים ראויים לצדק ודורשים תשומת לב שווה לזו המוקדשת למקרים אחרים. לפיכך אנו, לרבות חותמים המייצגים קורבנות פלסטינים, דוחקים בך לבקר עם צוותך בדחיפות בשטח הפלסטיני הכבוש, כלומר בגדה המערבית לרבות מזרח ירושלים וברצועת עזה. החובה להגן על קורבנות פלסטינים ולקדם את זכותם לגישה לצדק היא חובה משותפת. לשם כך, נמשיך לשתף פעולה עם משרדך ולתמוך בחקירתך את המצב במדינת פלסטין.
לסיכום וכחלק מהחקירה המתמשכת שלך, אנו קוראים למשרדך:
- לגנות בפומבי את הגדרתם של ארגוני חברה אזרחית פלסטיניים בידי ישראל כארגוני טרור ולקרוא לביטולה;
- לאשר בפומבי כי הפשעים שבוצעו לכאורה במהלך המתקפה על רצועת עזה, שישראל פתחה ללא התגרות בחודש אוגוסט 2022, ייבחנו במסגרת חקירתך את המצב בפלסטין;
- להאיץ בדחיפות את חקירת המצב בפלסטין, לרבות הפשעים נגד האנושות של אפרטהייד ורדיפה;
- לפרסם הצהרות מנע כדי להרתיע את ישראל מפני דפוסי פעולה העלולים לתרום לפשעים עכשוויים ונוספים נגד האנושות ולפשעי מלחמה. מההצהרות יעלה כי כל הפשעים שבוצעו לכאורה בפלסטין, לרבות רדיפת ארגונים פלסטיניים – מעשה לא אנושי במסגרת הפשע נגד האנושות של אפרטהייד – ייבחנו על ידי משרדך ויכללו בחקירה הנוכחית;
- לפעול מתוקף חלק 9 לאמנת רומא ולקרוא לירדן ולפלסטין, כמדינות שהן צד לבית הדין הפלילי הבינלאומי, ולמדינות אחרות שאינן צד לאמנת בית הדין לרבות מצרים, לשתף פעולה עם משרדך על ידי סיוע לפתיחת משרד-מדינה בפלסטין ובארגון ביקור דחוף בפלסטין, ובייחוד ברצועת עזה;
- לנקוט פעולה הולמת במסגרת מגבלות מימוש המנדט שאמנת רומא מעניקה לך, כדי למנוע ביצוע של פשעי מלחמה ופשעים נגד האנושות בפלסטין ולהרתיע מפני ביצועם.
