Among other things, the document emphasizes several key human rights issues, including the prohibition on torture and arbitrary arrests and the right of access to a lawyer. The document also commits the judiciary to publishing final court opinions while respecting privacy rights. For over a decade, Iran\u2019s revolutionary courts, which routinely run roughshod over defendants\u2019 due process rights, \u0026nbsp;\u003Ca href=\u0022https:\/\/www.hrw.org\/news\/2019\/11\/22\/iran-environmentalists-sentenced\u0022\u003Ehave rarely shared\u003C\/a\u003E a written copy of the verdict with those who sentenced.\u003C\/p\u003E\n\n\u003Cp\u003EThe Iranian judiciary\u2019s reaffirmation of its \u201ccommitment\u201d to respecting fundamental rights is on its face a positive development. But the judiciary\u2019s announcement should be greeted with skepticism and scrutiny given the reality that Iran\u2019s courts \u003Ca href=\u0022https:\/\/www.hrw.org\/world-report\/2020\/country-chapters\/iran\u0022\u003Esystematically violate defendants\u2019 due process rights\u003C\/a\u003E, and the judiciary and the country\u2019s intelligence apparatus \u2013 who are also empowered to act as judicial officers \u2013 regularly \u003Ca href=\u0022https:\/\/www.hrw.org\/news\/2019\/11\/22\/iran-environmentalists-sentenced\u0022\u003Earbitrarily arrest\u003C\/a\u003E and detain, and torture suspects. Moreover, defendants\u2019 right to legal defense of their choice is \u003Ca href=\u0022https:\/\/www.hrw.org\/news\/2018\/06\/05\/want-choose-your-lawyer-good-luck-iran\u0022\u003Eoften curtailed\u003C\/a\u003E, especially when they are accused of vaguely defined national security offenses. And these abuses start at the very top of the judicial bureaucracy\u2014\u003Ca href=\u0022https:\/\/www.hrw.org\/news\/2019\/03\/07\/iran-serious-rights-violator-lead-judiciary\u0022\u003ERaeesi\u003C\/a\u003E himself is a serious rights violator who was part of a four-person committee that ordered the execution of several thousand political prisoners in 1988.\u003C\/p\u003E\n\n\u003Cp\u003EMuch more than redundant documents that do not add to existing legal protections, firm political will is needed to enforce those protections and hold perpetrators, including judges, prosecutors, and interrogators, to account when they violate detainees\u2019 rights.
