Al-Rabia was charged in October 2008 with conspiracy to commit terrorism and attack civilians and providing material support for terrorism. The government alleged that he traveled to Afghanistan to meet with Osama Bin Laden and that he raised money for Al-Qaeda, commanded a supply depot at Tora Bora, and delivered supplies to Al-Qaeda fighters. His defense attorneys assert that he traveled to Afghanistan for humanitarian reasons and falsely confessed that he ran the supply depot after being subjected to abusive interrogations by the US military.

In September 2009, before the convening authority of the military commissions referred the charges, a federal judge granted his habeas corpus petition and ordered the government to take all necessary steps to arrange his release. On December 10, al-Rabia was sent home to his native Kuwait. (Last updated January 10, 2010)
