Q: Which Mexican Laws are Violated when Companies Discriminate
Based on Pregnancy?
Many domestic laws are violated, among them:
- Article 4 of the Constitution, which guarantees that men and women are equal
before the law, and that each person has a right to decide on the number and
spacing of her children.
- Articles 3 and 56 of the federal labor code, which prohibit distinctions
among workers based on sex.
- Article 133 (I.) of the federal labor code, which prohibits employers from
refusing to hire workers because of their sex.
- Article 164 of the federal labor code, which states that women have the same
rights and obligations as men.
- Article 123 (A) (V and XV) of the Constitution and Articles 170(1) and 166
of the federal labor code, which guarantee that pregnant women have the right to
work in safe conditions, and prohibits employers from forcing pregnant women to
work in jobs that are dangerous to their health in relation to their fetus.
