Does Pregnancy Discrimination Violate International Human Rights and Labor Law?

Yes. Various international treaties specifically prohibit discrimination on the grounds of sex, including pregnancy testing. The Guatemalan government has signed and agreed to abide by these international instruments:

• Convention 111 on Discrimination in Respect of Employment and Occupation of the International Labor Organization prohibits discrimination on the basis of sex with respect to access to employment and conditions of employment.

• Articles 2 and 26 of the International Covenant on Civil and Political Rights prohibit discrimination based on sex.

• Article 11 of the Convention on the Elimination of All Forms of Discrimination against Women expressly outlaws pregnancy-based employment discrimination.

• Articles 1 and 24 of the American Convention on Human Rights prohibit discrimination based on sex.
